1. Who we are

TheArkTech ("we", "us") is a private limited company registered in India, with its registered office at No. 5, Manikandan Nagar, Thelungupalayam, Coimbatore, Tamil Nadu, 641039 India . We build websites, web and mobile applications, and AI-powered automation for businesses. These terms apply to your use of thearktech.in and to any services you engage us for.

2. Quotes and engagement

Project scope, timeline, and pricing are agreed in writing before work begins. Quotes we provide are fixed for the agreed scope; changes to scope may change the price and timeline, and will always be agreed with you first before we proceed.

3. Payment

Unless agreed otherwise, projects are invoiced with an advance payment before work starts and the balance on delivery. Ongoing services (maintenance, hosting management, automation) are billed at the agreed recurring rate. Deliverables remain our property until payment is received in full.

4. Intellectual property

On full payment, you own the final deliverables we build for you — the design, code, and content created specifically for your project. We retain the right to use general-purpose tools, libraries, and know-how we bring to the project, and to showcase completed work in our portfolio unless you ask us not to.

5. Your responsibilities

You are responsible for the accuracy and legality of content, branding, and data you provide to us, and for confirming you have the rights to use them. Timely feedback and approvals help us keep to the agreed schedule.

6. Warranties and liability

We build and test our work with professional care, and we fix defects in the agreed scope reported within the support window agreed for your project. The website and our services are otherwise provided "as is". To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us for the specific work giving rise to the claim, and we are not liable for indirect or consequential losses such as lost profits or data.

7. Third-party services

Projects often depend on third-party services (hosting providers, domain registrars, payment gateways, APIs, WhatsApp). Those services have their own terms, and we are not responsible for their availability or changes to them.

8. Governing law

These terms are governed by the laws of India, and any disputes are subject to the jurisdiction of the courts of Coimbatore, Tamil Nadu.
